These Membership Terms apply to your purchase and use of the Mariya Private Club membership available through mariyamusic.com.
By purchasing a membership, you agree to these Membership Terms and our Privacy Policy.
1. Membership
Mariya Private Club is a paid membership service offering personalized communications and other benefits related to Mariya and the Mariya project.
Membership benefits currently include:

One personalized video message from Mariya each active membership month

The opportunity to send Mariya a question, thought, personal story, or something you would like to talk about

The possibility for a submitted story to inspire a future Mariya song or other creative work, subject to separate permission

Special prices on selected Mariya and Noir merchandise

Occasional member-only notes, photos, stories, or updates from Mariya and Noir
Membership benefits may evolve as the Mariya project develops.
2. Membership Fee
The membership fee is:
$30 USD per month
Your membership automatically renews each month until canceled.
Taxes, currency conversion fees, or other charges imposed by your financial institution or payment provider may apply depending on your location and payment method.
Payments are processed through third-party payment providers such as PayPal.
3. Automatic Renewal
By purchasing a membership, you authorize recurring monthly payments until you cancel your subscription.
Payments will normally be charged according to the billing cycle that begins when you first purchase the membership.
You are responsible for keeping your payment information current.
4. Cancellation
You may cancel your membership through the subscription settings in your member account.
Cancellation stops future recurring payments.
Your membership will normally remain active until the end of the period you have already paid for.
Cancellation does not automatically entitle you to a refund for payments already made.
5. Refunds
Except where required by applicable law, membership fees already paid are generally non-refundable.
If an incorrect or duplicate charge occurs because of a technical or billing error, please contact us so that we can review the issue.
Nothing in these Terms limits any rights you may have under applicable consumer protection law.
6. Your Monthly Personalized Video
Each active membership month includes one personalized video message from Mariya.
If you submit a question, thought, story, memory, worry, or personal message through the designated private form, Mariya will normally respond to what you shared in your monthly video.
If you do not submit anything during that month, you will still receive a personal check-in video from Mariya, addressed to you by name or nickname where appropriate.
It might be something simple — a hello, a “How have you been?”, or a few words from Mariya to let you know she hasn’t forgotten you.
Personalized videos are delivered by email.
When a submission is received, the personalized response will typically be sent within approximately one week.
Delivery times are estimates and may occasionally be longer because of production workload, technical problems, service interruptions, or other circumstances outside our reasonable control.
7. Monthly Submissions
Members may submit one question, thought, story, or personal message for their monthly personalized response.
Submitting something is optional.
You do not need to submit a message in order to receive your monthly personalized video.
Because a personalized video will still be provided when no submission is made, unused monthly video benefits do not accumulate or roll over into future months.
Please share only information that you are comfortable providing.
We may decline to respond directly to submissions that are unlawful, abusive, threatening, discriminatory, exploitative, dangerous, or otherwise inappropriate.
We may also decline requests that would require Mariya to provide professional medical, psychological, legal, financial, or other regulated advice.
In such cases, Mariya may instead provide a general personal message.
8. Mariya Is Not a Professional Adviser
Mariya’s responses are personal, creative, and entertainment-oriented communications.
They are not medical, psychological, legal, financial, or other professional advice.
Mariya does not replace a doctor, therapist, lawyer, financial adviser, emergency service, or other qualified professional.
If you are dealing with a serious health, mental health, legal, financial, or emergency situation, please seek appropriate professional assistance.
9. Personal Stories and Creative Works
Sharing a personal story with Mariya does not automatically give us permission to use that story in a song or other creative work.
You may separately choose to allow elements of your story to be considered as inspiration for future Mariya songs or other creative works.
Any such use is subject to separate permission and the applicable Story Submission Terms.
Submitting a story does not guarantee that it will be selected or used.
If your story inspires a released work, you may be offered recognition as a:
Story Contributor
You may also be offered the option to use your real name, a nickname, or remain anonymous.
Unless separately agreed in writing, Story Contributor credit does not automatically mean that you are a songwriter, co-writer, copyright owner, or royalty participant.

10. Merchandise Discounts
Members may receive special prices on selected Mariya or Noir merchandise.
Discounts may:

Apply only to selected products

Change from time to time

Be subject to product availability

Exclude shipping, taxes, customs duties, or other charges
Membership does not guarantee the continued availability of any particular product or discount.
11. Member Account
You may be required to create a Wix member account in order to access membership features.
You are responsible for keeping your login information secure.
Your membership is intended for your personal use and may not be transferred, resold, or shared with another person without permission.
12. Membership Content
Unless otherwise stated, music, videos, images, artwork, designs, text, graphics, photographs, and other Mariya-related content remain the intellectual property of their respective rights holders.
Your membership gives you a personal right to access and enjoy membership content.
It does not give you permission to commercially reproduce, sell, redistribute, impersonate, sublicense, or otherwise commercially exploit Mariya-related content.
Personalized videos are intended primarily for the recipient.
You may keep and enjoy your personalized video for personal use, but it may not be sold or used in a misleading or unauthorized commercial context.
13. AI and Creative Technology
Mariya is an AI-based artistic project.
Artificial intelligence, audio technology, video technology, and other creative tools may be used in the production of personalized messages and Mariya-related content.
Information submitted by members may be processed using such services when reasonably necessary to prepare the requested response or content.
Personal information is handled according to our Privacy Policy.
14. Changes to Membership Benefits
The Mariya project is evolving, and membership benefits may occasionally be added, changed, replaced, or discontinued.
We will make reasonable efforts to inform active members if a material change significantly affects the core paid membership service.
Nothing in this section limits rights available to you under applicable consumer law.
15. Suspension or Termination
We may suspend or terminate membership access where reasonably necessary, including in cases involving:

Fraud or payment abuse

Repeated payment failure

Harassment or abuse

Serious misuse of the service

Unauthorized commercial distribution of protected content

Serious violation of these Membership Terms

16. Third-Party Services
Membership features may depend on third-party services such as:
Wix
For website hosting, membership functions, forms, and related services.
PayPal
For payment and recurring subscription processing.
Email, storage, and file services
For communication and delivery of personalized content.
AI and creative technology providers
For assistance in producing personalized or creative content.
Temporary interruptions or changes affecting third-party services may occasionally affect the availability of membership features.
17. Service Availability
We aim to provide the membership service reliably, but uninterrupted availability cannot be guaranteed.
Temporary interruptions may occur because of maintenance, technical problems, platform outages, internet failures, or circumstances outside our reasonable control.
18. Limitation of Liability
To the extent permitted by applicable law, we are not responsible for indirect, incidental, special, or consequential losses arising from the use or temporary unavailability of the membership service.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.
19. Changes to These Terms
We may update these Membership Terms when the membership service, technology, business practices, or legal requirements change.
The latest version will be posted on mariyamusic.com with an updated Last Updated date.
Where appropriate, material changes may also be communicated to active members.
20. Governing Law
These Membership Terms are governed by the laws of Japan, except where mandatory consumer protection laws applicable in your country provide rights that cannot legally be excluded.
